A Division bench of Madhya Pradesh High Court comprising Chief Justice Syed Rafat Alam and Justice Alok Aradhe has issued notices to the GOI- CPCB and MOEF along with Chief Secretary Madhya Pradesh, Conservator of Forest, Hoshangabad Division, Collector Hoshangabad, Director Satpura Tiger Reserve to submit their reply within four weeks.
The petition was filed by Salim Khan from Hoshangabad. In 1980 the state Government spent crores in plantation on 1500 acres of land in which plants of Mahua, Harra, Bahera, Sagon, Amla and valuable trees were planted at Dulariya Kurd, Dob, Kharda and Ghogari Kheda 15 and 17 khasra number 183,and 185.
The petitioner contended before the court that the plantation comes under the reserve forest area and the State Forest Department is cutting the forests and the allotting land for residential purpose. which is against the Forest act and wildlife conservation act. The Apex Court had stated that in reserve forest area neither mining nor any other business will be allowed. Advocate K K Pandey and Kouslendra Pandey appeared on behalf of the petitioner.
